Terms of use

In this document we wish to introduce our Terms of Service. These terms represent a clear outline of how we conduct our business.

We don't accept the following activities in our network:
1. Adult related website/business.
2. Gambling related website/business.
3. Hacking/Attacking related website/service/business.
4. Website which encourage sedition and/or terrorism related activities.
5. File/Image hosting/sharing/storing is violated on shared hosting.




Bandwidth Usage

Shared Hosting
We will not provide extra traffic, when you consume all your traffic the only choice is to upgrade to the next plan.

Dedicated server

Metered Bandwidth:

Clients agree to pay any and all bandwidth overage charges accrued on their account from the previous billing cycle.
Bandwidth overage charges are billed per gigabyte at a rate of $0.25/Gb (twenty five cents) for U.S. servers or $0.075/Gb for EU servers over the allotted bandwidth on the service.
Nilehoster is not responsible for spikes in bandwidth use that are caused on a client's website/server for any reason.
The Client assumes liability for all bandwidth use to and from their operation.
If clients are issued with an exceeded anticipated bandwidth notification, they are required to agree payment arrangements within 24 hours of that notification to prevent possible service interruption until adequate arrangements are made. These arrangements may include being required to pro-actively upgrade bandwidth.

Note: You always can monitor your bandwidth consumption from client area, you can shut the switch port off before it goes over limits.

Fraud

In the event fraudulent activity is discovered, the fraudulent account, and all related accounts,are subject to immediate suspension or termination at the sole discretion of Nilehoster. All information available to Nilehoster about the fraudulent account/service shall be submitted to both local authorities, as well any relevant organizations. All fraudulent activity is investigated, and all fraudulent clients will be prosecuted to the fullest extent of the law.



Abuse/Spam/Bulk Email Policy

Nilehoster reserves the right to deny mail delivery from any servers hosted on our network if they are believed to be involved in SPAM or SPIM activities.
This includes spam support services such as DNS or spam advertised web sites. Our abuse department will locate abusive servers based on public blacklist monitors, source abuse reporting from external networks, and other means.
If our abuse department receives a report or otherwise becomes aware of abuse-related activities on our network, we will identify the server the abuse was initially sent from (via IP and in some cases by domain) and create a ticket on behalf of the user who occupies the server with information regarding the abuse, such as logs describing the abuse and an explanation of what abuse took place.

Nilehoster have the right to suspend and/or terminate the service contract in the next billing cycle if the client refuses to cooperate with our abuse team to solve abuse-related issues on their website and/or server within the range of time provided to reply, or if we receive too many reports regarding the same service. Nilehoster will not be responsible of any loss of data.



DMCA Complaints

Nilehoster handles any and all Digital Millennium Copyright Act (.DMCA.) complaints very seriously, and will thoroughly investigate each complaint received. Nilehoster reserves the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation.

Refund Policy

Shared Hosting
We offer a 30 days money-back guarantee for shared, reseller & virtual/cloud servers. If you are not totally satisfied with our service, simply cancel your agreement within 30 days from your account signup date.
Our money back guarantee excludes any TOS violations - if your service is stopped / suspended due to a terms violation, we will not be able to refund your money.

Dedicated Servers
We offer a 30 days money back guarantee on dedicated servers. You can request a refund under the following circumstances during your first 30 days from your account sign up date:
1. Late in server deploy (time more than we promised) which may cause any kind of lose to our client.
2. Hardware failure.
3. Network/Power Outage. (Doesn't include DDoS/Flood/Attacks related issues)

The money back guarantee excludes any TOS violations - if your service is stopped / suspended due to a terms violation, we will not be able to refund your money.
Refund does not include setup, processing and add-on fees.



Cancellation

Shared Hosting & Virtual Server
Nilehoster Requires at least 7 days notice of cancellation prior to the billing renewal date for the upcoming billing cycle, submitted via ‘Client Area’ or ‘Support Ticket’.
If the client is late paying the invoice, the service will be suspended until payment has been processed. If after 15 days of suspension for shared hosting or 3 days for virtual/cloud server, payment has not been made, service will be automatically terminated and we will not be responsible of any loss of data.

Dedicated servers
Nilehoster Requires at least 7 days notice of cancellation prior to the billing renewal date for the upcoming billing cycle, submitted via ‘Client Area’ or ‘Support Ticket’.
After the invoice due date has passed without receiving the payment, we will take this as a cancellation request and the dedicated server will be cancelled automatically and your billing account will be permanently closed. We will not be responsible for any data loss.

Nilehoster has the right to permanently close the billing account of any client who leaves us without giving any cancellation notice.
